1. Just Because You Have Been Arrested Doesn't Mean You Are Charged

It is important to realize that just because you were arrested doesn't actually mean that you have been charged yet. What happens is that you are taken to a holding cell. While they hold you they have a certain amount of time that they can keep you without charging you. In some cases you will be charged right away, if they have enough evidence against you. But in other cases, you could be in a holding cell for a day or two and then be let go without any charges. This is why you should be sure to protect yourself during this holding time. For example, if you have been arrested for a DUI, then you should always request a DUI lawyer the minute you are arrested. There is too much at stake to not have the best legal advice as to how to protect yourself. In fact, the time that you are in holding and waiting to be charged is critical because the police will try to question you. What you say during that time will play a big role in whether or not you are charged. Thus, getting legal advice up front will be the best way to keep yourself safe.

2. Prepare To Make Bail

If you think that there is a good chance you are going to be charged, you should start thinking about how to get bail together, (assuming that you are pleading not guilty to the charges.) Some people think that they won't post bail because the time that they spend in prison will just go towards the sentence if they are found guilty. However, in the majority of cases this thinking is flawed and you should generally post bail. This is because the time that you spend out of jail waiting for your trial can help to prove your character and good behavior, it will only work to your advantage. Additionally, if you aren't found guilty, you will have spend all this time in jail without having needing to. This is why it is best to post bail if given the option.
